1. Scope of Application

These General Terms and Conditions (hereinafter referred to as “T&C”) apply to all contracts concluded between you as a consumer or business and us (EA Kick Mastery) via our online shop at eakickmastery.com.

2. Contractual Partner and Conclusion of Contract

The purchase contract is concluded with EA Kick Mastery. The presentation of the products in the online shop does not constitute a legally binding offer but a non-binding online catalog. By clicking the “Buy Now” or “Place Order” button, you place a binding order for the goods contained in your shopping cart. The confirmation of receipt of the order follows immediately after the order has been sent via an automated email. This email confirmation constitutes our acceptance of the contract.

3. Prices and Shipping Costs

All prices stated on the website are final prices and include the statutory value-added tax (VAT) where applicable. In addition to the stated product prices, we may charge shipping costs for delivery. The exact shipping costs will be clearly communicated to you in the shopping cart system and on the order page.

4. Payment Terms

We offer various payment methods, including Credit Card, PayPal, and other standard payment gateways. The purchase price is due immediately upon conclusion of the contract.

5. Retention of Title

The delivered goods remain our property until full payment has been made.

6. Warranty and Liability

The statutory warranty rights apply to all products purchased from our store. We are fully liable for intent and gross negligence. For slight negligence, we are only liable for damages resulting from a breach of essential contractual obligations, in which case liability is limited to foreseeable, typical damages.

7. Applicable Law

German law shall apply exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only to the extent that it does not deprive them of the protection granted by mandatory provisions of the law of the country in which they have their habitual residence.
